INTRODUCTION
At Radiant Recruitment your privacy is important to us. We are committed to the privacy of all candidates, clients, referees and suppliers. This document outlines our policy with respect to the ‘Privacy Act 1998’ and the ‘Australian Privacy Principles’.
This Privacy Policy explains how we collect, hold, maintain, use and disclose personal and sensitive information.
WHAT IS PERSONAL INFORMATION?
Personal information is any information or opinion about an individual, examples of which include name, address, phone number and employment history.
WHAT IS SENSITIVE INFORMATION?
Sensitive information is any information or opinion about an individual, examples of which include racial or ethnic origins, political opinions, religious beliefs, philosophical beliefs, memberships of professional or trade associations, sexual preferences, criminal records and health information.
We will only collect sensitive information where we have your consent to do so and where the information is necessary for our business activities.
INFORMATION WE COLLECT AND HOLD
Information that we collect and hold is information that is reasonably necessary for the proper performance of our functions or activities.
CANDIDATES
The type of information that we typically collect and hold about Candidates is information that is necessary to assess amenability to work offers, work availability and suitability for placements.
CLIENTS
The type of information that we typically collect and hold about Clients is information that is necessary to help us manage the presentation and delivery of our services.
REFEREES
The type of information that we typically collect and hold about Referees is information that is necessary to help to make determinations about the suitability of one of our Candidates for particular jobs or particular types of work.
SUPPLIERS
The type of information that we typically collect and hold about Suppliers is information that is necessary to help in determining the suitability of supplied services or products
HOW WE COLLECT YOUR INFORMATION
Personal and sensitive information may be collected:

In person or during a telephone call

Via email or other technology communications

Via competency or medical checks

During work rights status determination

Social Media and other publically available information
HOW WE HOLD YOUR INFORMATION
Your personal and sensitive information is stored securely in our electronic information record systems.
WHEN WE DISCLOSE YOUR INFORMATION
We will seek your consent prior to disclosing your personal or sensitive information unless we are required to do so under Australian law or due to a court/tribunal order.
ACCESS TO INFORMATION
Subject to some exceptions set out in privacy law, you can gain access to your personal or sensitive information that we hold.
Important exceptions include:

evaluative opinion material obtained confidentially in the course of our performing reference checks; and access that would impact on the privacy rights of other people. In many cases evaluative material contained in references that we obtain will be collected under obligations of confidentiality that the person who gave us that information is entitled to expect will be observed. We do refuse access if it would breach confidentiality.

CORRECTION OF INFORMATION
If you believe that we hold personal or sensitive information that is inaccurate, incomplete or is not up-to-date we will take steps to correct the information.

QUESTIONS OR COMPLAINTS
If you have any questions relating to privacy or if you have a privacy complaint, please contact our Privacy Officer via the details below. We will respond to the question or complaint as quickly as possible.
If we receive a complaint:

We will take steps to confirm the authenticity of the complaint and the contact details provided to us to ensure that we are responding to you or to a person whom you have authorised to receive information about your complaint

We may ask for clarification of certain aspects of the complaint and for further detail

We will consider the complaint and may make inquiries of people who can assist us to establish what has happened and why

If the complaint can be resolved via access and correction, we will suggest these to you as possible solutions

If we believe that your complaint may be capable of some other solution we will suggest that solution to you, on a confidential and without prejudice basis in our response

If the complaint cannot be resolved by means that we propose in our response, we will suggest that you take your complaint to the Office of the Australian Information Commissioner.
